1. Who we are

2. Acceptance
This agreement becomes binding when you create an account or use the service. You confirm that you are at least 18 years old (or the age of majority where you live) and have the legal capacity to accept these terms. If you use Pingomania on behalf of an organization, you confirm you are authorized to bind it.
3. The service
Pingomania lets customers run on-demand network checks and monitoring of public web resources from the devices of real participants on real internet providers, and lets participants accept and complete those checks for a reward. The service is provided "as is". We may add, change, or remove features. Pingomania does not provide proxy access and gives customers no access to a participant's device, identity, or connection.
4. Accounts and acceptable use
Keep your credentials confidential, provide accurate information, and do not resell or sublicense the service without our written permission. You agree to use Pingomania only to check resources you are authorized to test, and not to run load or denial-of-service attacks, circumvent access controls, infringe others' rights, or use the service for any unlawful purpose. We may suspend or terminate accounts that violate these terms or threaten the security of the service.
5. Credits, pricing and payment
Pingomania uses prepaid account credits. You add credits to your account and they are consumed as you run checks and monitoring. The price of a check is shown before you create it, and prices and available balance are shown in the app and at checkout in your selected currency.
Web purchases of credits are sold through Paddle.com Market Ltd and its affiliates, which act as the Merchant of Record for those purchases and handle payment, billing, and related taxes. Your purchase is also subject to Paddle's Buyer Terms. Purchases made inside the iOS or macOS app are processed by Apple, and inside the Android app by Google, under their respective terms.
6. Refunds
New customers may request a full refund within 14 calendar days of their first paid charge, for any reason. Credits already spent on completed checks are not refundable because the service was delivered; unused credits and cases of material defect or extended outage are covered by our Refund Policy, which forms part of these terms.
7. Participant rewards
Participation is voluntary. Rewards, resource limits, and requirements are shown before a participant accepts a task, and any task can be declined or stopped. Rewards are credited for validated, completed checks; balance, history, and withdrawals are available in the secure web account. We may withhold rewards obtained through fraud, automation, or abuse.
8. Intellectual property
Pingomania, its software, design, and trademarks are owned by OPSoft. These terms do not transfer any such rights to you. You retain rights to the content you submit, and grant us the limited rights needed to operate the service.
9. Privacy
Our Privacy Policy explains what we collect and how we use it, and forms part of these terms.
10. Disclaimers and limitation of liability
The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that checks will be accepted within any time, that results are error-free, or that the service will be uninterrupted. To the maximum extent permitted by law, OPSoft is not liable for indirect, incidental, or consequential damages, or for third-party conduct. Our total liability for any claim is limited to the amount you paid for the service giving rise to the claim in the 12 months before it arose.
11. Termination
You may stop using the service and delete your account at any time from the app or the account deletion page. We may suspend or end access for violations of these terms or to protect users and the service.
12. Changes to these terms
We may update these terms as the service and legal requirements change. We will post the new date here and, where a change materially affects your rights, provide additional notice. Continued use after an update means you accept the revised terms.
13. Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules, and disputes are subject to the courts located in Wyoming, unless mandatory law in your country of residence provides otherwise.
